1. Description of Service

MaxGrind is a fitness and workout tracking application that allows users to create and manage personalized training routines, log workout sessions, track performance over time, and access fitness-related tools and content.

The Service is available as a mobile application on the Apple App Store (iOS) and Google Play Store (Android), and as a web application at maxgrind.app.

2. Account Registration

To use MaxGrind, you must create an account with a valid email address. By registering, you agree to:

• Provide accurate, complete, and current registration information
• Maintain and promptly update your account information
• Keep your password confidential and not share it with any third party
• Notify us immediately of any unauthorized use of your account at maxgrindteam@gmail.com
• Accept responsibility for all activities that occur under your account

You must be at least 13 years of age to create an account. By registering, you represent and warrant that you meet this age requirement.

4. Acceptable Use

You agree to use MaxGrind only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service in any way that violates applicable laws or regulations
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
• Attempt to gain unauthorized access to any systems, servers, or networks connected to the Service
• Transmit any unsolicited or unauthorized advertising or promotional materials
• Upload, transmit, or distribute harmful, offensive, defamatory, or infringing content
• Use automated bots, scrapers, or data mining tools to access the Service
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the integrity, performance, or security of the Service
• Use the Service to collect or harvest data about other users without their consent

We reserve the right to suspend or terminate accounts that violate these acceptable use standards, without prior notice.

6. Intellectual Property

All content, features, and functionality of MaxGrind — including but not limited to the app interface, text, graphics, logos, icons, images, audio clips, code, and software — are the exclusive property of Barclay Leach and are protected by applicable intellectual property laws in Peru and internationally.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App and its content solely for your personal, non-commercial fitness tracking purposes. This license does not include the right to: reproduce, modify, distribute, sell, sublicense, or create derivative works from any part of the Service.

7. User-Generated Content

Content you create within MaxGrind — including workout logs, custom exercise configurations, training routines, profile information, and session notes — remains your property. By using the Service, you grant us a limited, worldwide, royalty-free license to store, process, and display your content solely for the purpose of operating and providing the Service to you.

We do not claim ownership of your personal fitness data. We do not sell or monetize user-generated content.

8. Third-Party Services and Links

MaxGrind integrates with and relies on third-party services including Supabase (data storage), Vercel (web hosting), RevenueCat (subscription management), Google AdSense (advertising), and app distribution through Apple App Store and Google Play Store. Your use of these third-party services is subject to their respective terms of service and privacy policies.

We use Google AdSense to serve advertisements on our website. By using the Service, you acknowledge and agree that Google AdSense may collect and use data about your visits to serve personalized or non-personalized advertisements, subject to Google's Privacy Policy. You can adjust your consent settings at any time through our Cookie Consent Banner or via Google's Ad Settings.

We are not responsible for the content, privacy practices, or terms of any third-party services or websites. Links to external sites within the Service are provided for convenience only and do not constitute endorsement.

11. Indemnification

You agree to defend, indemnify, and hold harmless Barclay Leach and his representatives from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights or privacy rights
• Any content you submit, post, or transmit through the Service

12. Age Requirements

MaxGrind is intended for users 13 years of age and older. By creating an account, you represent and warrant that you are at least 13 years old. Users between the ages of 13 and 18 must have parental or guardian consent to use the Service.

If we become aware that a user under the age of 13 has created an account, we will take steps to promptly delete the account and all associated data.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Peru, without regard to its conflict of law provisions. Any legal proceedings arising out of or relating to these Terms or your use of MaxGrind shall be subject to the exclusive jurisdiction of the civil courts of Lima, Peru.

For users located in the European Union: nothing in these Terms affects your rights under applicable EU consumer protection laws and regulations, including the right to take legal action before the courts of your country of residence.

14. Termination

We reserve the right to suspend, restrict, or terminate your account and access to the Service at any time, with or without cause, with or without notice, effective immediately. Reasons for termination may include, but are not limited to, violation of these Terms, conduct that harms the Service or other users, or legal requirements.

You may terminate your account at any time by deleting it from within the App (Settings → Profile → Delete Account) or by contacting us. Upon account deletion, your right to use the Service ceases immediately. Data deletion follows the process described in our Privacy Policy.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, limitation of liability, and indemnification.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and provide notice through the app or via email where appropriate.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Barclay Leach regarding your use of MaxGrind and supersede all prior and contemporaneous agreements, representations, and understandings.
